Got2cy Web Development cc Trading as SharkDiving.co acts as an agent offering a variety of products, tours, services, accommodation, transportation and gift vouchers ("products & services") through its website (SharkDiving.co.) and designated affiliated websites. We are not the supplier of these products & services.

SharkDiving.co makes all reasonable endeavours to use quality service providers within the Travel, Tourism, Transportation and Accommodation sectors to provide the services & products featured on SharkDiving.co website.

Because our Terms & Conditions contain legal obligations, we encourage you to read them carefully. They form the basis on which bookings are accepted by SharkDiving.co.

Unless otherwise stated, purchases made through SharkDiving.co or any SharkDiving.co affiliated website are subject to these Terms & Conditions; in all booking arrangements, the person making the booking "client" shall be deemed to have read and accepted these conditions on behalf of the persons named in the booking.

No variation to these Terms & Conditions shall take effect unless made in writing by and with the authority of SharkDiving.co.

Terms of Use

1. By using SharkDiving.co or any SharkDiving.co affiliated websites, you agree to be legally bound by these terms, which shall take effect immediately.
2. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use SharkDiving.co or any SharkDiving.co affiliated website.
3. SharkDiving.co may change these Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by SharkDiving.co. Your continued use of SharkDiving.co or a SharkDiving.co affiliated website after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
4. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any SharkDiving.co content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of SharkDiving.co content requires the prior written permission of SharkDiving.co.
5. You agree to use SharkDiving.co and any SharkDiving.co affiliated websites for lawful purposes only, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of SharkDiving.co.
6. Your use of SharkDiving.co or any SharkDiving.co affiliated websites is intended for personal, non-commercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by SharkDiving.co.
7. You represent and warrant that you (a) have not previously been suspended by SharkDiving.co or otherwise banned from the site; (b) are not a direct competitor of SharkDiving.co; and (c) that you have full power and authority to enter into these Terms of Service and in doing so will not violate any other agreement to which you are a party.
8. We grant you permission to use the site subject to the restrictions in these Terms & Conditions. You therefore access and use the site at your own risk.

Service Availability, Modifications & Amendments

9. All tours, products and services offered by SharkDiving.co are as indicated on the SharkDiving.co website or any SharkDiving.co affiliated website. SharkDiving.co is not responsible or liable for any information that it does not directly provide.
10. All requests for modifications/amendments must be directed to the SharkDiving.co Customer Care Team (This email address is being protected from spambots. You need JavaScript enabled to view it.) who will process the request.

  1. SharkDiving.co does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by our Customer Care team no less than three (3) days prior to your confirmed travel date.
  2. All date-change requests and amendments are subject to availability by the service provider(s); SharkDiving.co cannot guarantee the success of any date-change request(s).
  3. If you request a date change within three (3) days or less of your confirmed travel date, SharkDiving.co will attempt to honor your request; however changes made three (3) days or less from your original travel date may incur additional fees. For multi-day and overnight tours, date changes made within seven (7) days of your confirmed travel date may also incur additional fees from our service providers.
  4. If you make a purchase using a SharkDiving.co promotion code, or if you accept a discount or special-offer price during the SharkDiving.co checkout process, you may invalidate your discount or special-offer price by making any changes or amendments to your itinerary once your purchase is complete. SharkDiving.co may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However SharkDiving.co reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.

11. Occasionally our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, etc. As a result, SharkDiving.co reserves the right to cancel, change or substitute any service, tour or product that you have booked through SharkDiving.co or any SharkDiving.co affiliated websites, at any time, for any reason.

  1. In such cases, if you are dissatisfied with the alternatives offered, you may be entitled to refund of the original purchase price. This will be at the sole discretion of SharkDiving.co
  2. Notwithstanding the above, when we are informed in advance by our agents, service providers and/or suppliers of a significant change to a booking and/or to a tour or product, we make every reasonable effort to notify the client, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.

Pricing & Inclusions/Exclusions

12. All Prices quoted on the SharkDiving.co website is as stated on the date that the page was published. SharkDiving.co reserves the right to amend and adjust prices from time to time due to increases in tour prices, hotel prices, transport and fuel prices, government and regional levies and taxes as well as currency fluctuations. Prices may not be guaranteed.
13. Prices listed on SharkDiving.co and any SharkDiving.co affiliated websites are per person, unless otherwise specified.
14. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by SharkDiving.co.
15. Price quotations are subject to change without notice, until a booking has been confirmed.
16. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.
17. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under "Inclusions" on the service pages of the SharkDiving.co or SharkDiving.co affiliated websites.

Bookings, Payments, Cancellations & Refunds

18. A signed credit card authorisation form, credit card pre-authorisation, applicable deposit or full payment is required to make a booking.
19. A booking will only be confirmed once a signed credit card authorisation form, credit card pre-authorisation or an applicable payment has been received and the client has read and accepted SharkDiving.co's Terms & Conditions.
20. For all Multi Day Tours, Private Charters and Accommodation either a full payment or a 50% non-refundable deposit will be required upon confirmation of the booking with the balance payable within 30 days of the confirmed tour date.
21. SharkDiving.co reserves the right to cancel any booking(s) for which payment has not been made by the due date. In such an event; any deposit paid will be forfeited to SharkDiving.co.
22. Any bookings made through the SharkDiving.co affiliated website "www.webtickets.co.za" will be subject to a 10% plus VAT non-refundable deposit.
23. Any bookings made through the SharkDiving.co affiliated website "www.computicket.co.za" will be subject to a non-refundable deposit of 6% on credit card payments and 8.75% on debit card payments.
24. SharkDiving.co accepts credit cards (Visa & Mastercard), electronic bank transfers (EFT) and international bank transfers. 
25. There may be additional charges or service fees for processing credit or debit card payments through the SharkDiving.co website.
26. Payments made by credit or debit card through any of SharkDiving.co designated Service Provider(s) may incur additional service fees.
27. Payments made by debit or credit cards will be listed as GOT2CY WEB DEVELOPMENT (trading as SHARKDIVING.CO) on the credit or debit card statements.
28. Should the client cancel the tour less than 48 hours prior to the confirmed date of the tour, a 100% cancellation fee will be applicable.
29. Should the client cancel the tour less than 72 hours prior to the confirmed date of the tour, a 75% cancellation fee will be applicable.
30. Should the client cancel the tour less than 2 weeks prior to the confirmed date of the tour, a 50% cancellation fee will be applicable
31. Should the client arrive late for the tour or not arrive at all for the tour ("No Show"), a 100% cancellation fee will apply. 
32. In the event that a tour is cancelled due to inclement weather an alternative date will be negotiated or a refund may be provided.
33. In all events the SharkDiving.co designated Service Provider(s) Cancellation Policies will supersede the Terms and Conditions of SharkDiving.co and can be made available upon request.
34. All credit card or debit card refunds will be subject to a 4.5% admin. fee whether booked through SharkDiving.co or any Shark Diving.co affiliated websites 
35. Note that shark sightings are not guaranteed. Refunds will therefore not be considered in the event of non-sightings, however, a second tour may be offered in case of no sightings.
36. No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, transport, meals or any other services utilized.
37. The value of the transaction may be subject to taxes, foreign transaction, currency exchange or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on SharkDiving.co and SharkDiving.co affiliated websites, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees. Please note for bookings made in Brazil, the tax IOF (Tax Upon Financial Operations, 6.38%) is not included in the final booking value and will be charged to the credit or debit card used to make the purchase.

SharkDiving.co Gift Certificates

37. SharkDiving.co Gift Certificates can only be redeemed on the SharkDiving.co website.
38. SharkDiving.co Gift Certificates are redeemable against any product or service offered on the SharkDiving.co website.
39. SharkDiving.co Gift Certificates are valid for six (6) months from the date of purchase.
40. SharkDiving.co Gift Certificates are not redeemable for cash.
41. SharkDiving.co reserves the right to cancel Gift Certificates obtained fraudulently.
42. SharkDiving.co is not responsible for stolen or lost Gift Certificates.
43. All Gift Certificate sales are final. Gift Certificates are non-transferable and not refundable in any circumstance.

Passports, Visas & Insurance

44. It is the responsibility of all passengers, regardless of nationality and destination, to check with the consulate of the country they are visiting for current entry requirements.
45. As visa and health requirements are subject to change without notice, we recommend that you verify health and visa requirements with the appropriate consulate prior to departure.
46. We strongly recommend that you purchase a comprehensive Travel Insurance Policy prior to departure. If you cancel your trip or significantly alter travel dates, many policies will reimburse the cost of cancellation fees and related expenses.

Disclaimers & Limitations of Liability

47. Under no circumstances will SharkDiving.co or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of SharkDiving.co regardless of the form of action.
48. SharkDiving.co and its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of client(s), shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours.
49. Furthermore, SharkDiving.co and its agents and suppliers accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.
50. The SharkDiving.co content - including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to SharkDiving.co and/or to a SharkDiving.co affiliated website, service provider, operator and/or distribution partner is provided "AS IS" and on an "AS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
51. At SharkDiving.co we check and recheck the details about all the products and services we offer for accuracy. However, SharkDiving.co does not warrant that functionality, content or information contained on SharkDiving.co or any SharkDiving.co affiliated website will be uninterrupted or error free, that defects will be corrected, or that SharkDiving.co or the servers that make it available are free of viruses or bugs.
52. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Restrictions on Use

53. You agree that you will not, and will not assist or enable others to:

  1. use the SharkDiving.co website to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user's use of the website;
  2. use the SharkDiving.co website to submit or transmit spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging, whether commercial in nature or not;
  3. use the SharkDiving.co website in a manner that may create a conflict of interest, such as trading reviews with other business owners or writing or soliciting reviews;
  4. use the SharkDiving.co website to promote bigotry or discrimination against protected classes;
  5. use the SharkDiving.co website to violate any third-party right, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right;
  6. use the SharkDiving.co website to submit or transmit pornography or illegal content;
  7. use the SharkDiving.co website to solicit personal information from minors or to harm or threaten to cause harm to minors;
  8. use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index the SharkDiving.co website or any site content;
  9. attempt to gain unauthorized access to the SharkDiving.co website, user accounts, computer systems or networks connected to the site through hacking, password mining or any other means; use the site or any site content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses"); use any device, software or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the site; make excessive traffic demands; use the site to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to, the site or site content; remove, circumvent, disable, damage or otherwise interfere with any security-related features of the site, features that prevent or restrict the use or copying of site content, or features that enforce limitations on the use of the site.

Declaration by the Client

I, the client booking the tour hereby declare that I have read and accept unconditionally SharkDiving.co's terms and conditions and I am aware that participation is at my/our own risk.

All images, videos and documents on the SharkDiving.co's website is displayed in good faith and are provided with the originators consent / permission to the best of our knowledge.  If however, any such content is being displayed without permission or is in violation of any copyright.  Please contact us immediately such that we may either gain such consent or remove the content.   In such an event kindly accept our sincere apologies as no malicious intent or profiteering was intended but rather an attempt to promote the Shark & Travel industry as a whole.
